    Estate Planning with Canada – Planning Considerations and Update

    Description:

    This presentation provides an overview of key points of consideration in cross-border estate planning for global estates involving Canadian assets and beneficiaries, as well as Canadian estates with non-Canadian beneficiaries.  The presentation also provides an update on new Canadian federal and provincial laws, including tax laws, that impact estate practitioners, as well as investors who deal with Canada.  The presentation will particularly discuss:

    • Present tax rates across Canada and the continued availability of planning for Canadians and foreign trusts with Canadian beneficiaries
    • The present position in Canada on US revocable trusts and pour-over Wills in a cross-border context
    • Planning suggestions when dealing with non-Canadian estates with Canadian assets and accounts, particularly in “probate tax” jurisdictions like Ontario
    • New enhanced reporting requirements for trusts (including bare trusts), as well as new enhanced rules for the advance reporting and notification of certain transactions to the Canadian revenue authority
    • Canada’s new residential housing purchase bans affecting non-Canadians, as well as new tax measures at the federal and provincial levels aimed at curtailing speculation and investments in the Canadian residential real estate market by non-Canadians

    The OCBA is doing its first ever Diversity and Inclusion Certification Program. The goal of the program is to have participants more informed about issues surrounding diversity and inclusion and their own personal implicit biases.

    Each session will feature a moderator and panel of individuals both inside and outside the legal profession, including leaders from each represented community and the broader Central Florida community.

    Participants must complete five (5) of the six (6) courses in order to earn the OCBA Certificate in Diversity & Inclusion Awareness. 

    Individuals who complete the certification program will be able to display a certification seal/logo on their law firm website as an indicator that they are dedicated to acceptance, allyship, and personal growth in order to better serve a broad range of diverse clientele.
