    Small Business Cases Under the Bankruptcy Code and the Small Business Reorganization Act of 2019

    Description: “Small business debtors” have struggled to reorganize under Chapter 11 of the Bankruptcy Code. In 2005, the Code was amended to facilitate reorganization by “small business debtors”, but the amendments have not fully addressed the problems and have raised many issues. In a further effort to facilitate reorganization by small business debtors, the Small Business Reorganization Act of 2019 (the “SBRA”) adds to Chapter 11 of the Code a new subchapter V (Small Business Debtor Reorganization). The stated purpose of SBRA is to streamline the bankruptcy process by which small business debtors reorganize and rehabilitate their financial affairs. We will discuss the special provisions of the Code applicable to small business debtors, including the SBRA.
