Intellectual Property Primer for the Business Law Practitioner

Description: Attorneys Amber Davis and Kevin Wimberly will present on the importance of conducting a trademark search before creating a new entity as well as the legal and ethical pitfalls of failing to do so. Other topics of interest to the business law practitioner include: difference between state and federal trademark registrations and why it is important to search both; the importance of using the ® symbol once a client obtains a federal registration; why employment and independent contractor agreements need a work for hire provision that includes assignments of any and all IP created by the employee and/or independent contractor; a brief overview of the different areas of IP (patents, trademarks, copyright, trade secrets); and why a client’s Terms of Use and Privacy Policy are extremely important and must be written by an attorney who specializes in this area. Time permitting, attendees will have an opportunity to participate in a Q&A session.
