Probate and Trust Litigation Issues
Description: This program will address various tips and techniques for attorneys to be able to successfully litigate probate and trust litigation cases in Court. The techniques and tips can be used in various cases involving claims of undue influence, lack of capacity, and improper use of a power of attorney. Techniques and tips will flow from statutory law, case law, and general litigation experience. The program will also discuss common evidentiary issues that arise in probate and trust litigation cases and how to overcome those evidentiary issues.
